Why now
NSW Strata Law Has Changed 6 Times Since December 2023
The reforms put new duties on strata committees, new limits on service contracts and new rules on how by-laws can be changed. By-laws and contracts written before 2025 are worth checking.
- Service contracts: unfair terms in standard form contracts with cleaners, building managers and strata managers are banned for contracts entered, renewed or varied from 1 July 2025.
- Building managers: new duties and disclosure rules apply, and the Tribunal can vary or end a building or strata management agreement on new grounds.
- Committee duties: committee members now have statutory duties of care and diligence, must complete NSW Fair Trading training within 3 months of appointment, and legal cost decisions must be transparent.
- By-laws: changes to common property rights by-laws now need the affected owner's consent, and sustainability infrastructure cannot be banned on appearance grounds alone.

Contracts and common property
Service contracts are where schemes lose the most money quietly: long terms, automatic renewals, wide termination fees and terms that are now unenforceable. We give the committee a plain-English summary of what each contract commits the scheme to, with unfair terms flagged.
