The REIQ Contract

Most Queensland sales use the standard REIQ contract — the Contract for Houses and Residential Land — with special conditions bolted on. We read those conditions closely, because that is where risk is shifted onto the buyer.

5 Business-Day Cooling-Off

QLD contracts usually carry a statutory cooling-off period of 5 business days, ending at 5pm on the fifth business day. If you terminate within it, the seller may withhold a penalty of 0.25% of the purchase price. Auction purchases have no cooling-off. Confirm the position — exceptions apply.

Seller Disclosure Statement

Queensland now has a seller disclosure regime: from 1 August 2025 a seller must give the buyer a statutory disclosure statement (and prescribed materials) before the contract is signed. We check disclosure was given and correct — confirm current requirements, as the regime is new.

Transfer Duty

Stamp duty in Queensland is “transfer duty”, administered by the Queensland Revenue Office, with concessions for eligible home and first-home buyers. Rates and thresholds change — we flag what may apply and point you to the Queensland Revenue Office to confirm.

Foreign Buyer Duty (AFAD)

Foreign buyers of Queensland property may face additional foreign acquirer duty (AFAD) on top of transfer duty. If a foreign person, company or trust is involved, we identify the issue early — the current rate should be confirmed with the Queensland Revenue Office.

Body Corporate

In Queensland the strata body is the “Body Corporate”. For units, townhouses and apartments we review the body corporate position — levies, sinking fund, by-laws and disputes — so you know what you are buying into.
