No Automatic Cooling-Off
There is no statutory cooling-off period in WA. Unless a cooling-off right is specifically negotiated into your contract, an accepted Offer and Acceptance binds you. Have a lawyer review it before you offer.
The Offer and Acceptance (O&A)
WA sales usually use a REIWA / Law Society Offer and Acceptance on the 2022 Joint Form of General Conditions, plus annexed special conditions. The document you sign to make an offer is the contract.
Settlement Agents vs Lawyers
WA transactions are traditionally handled by licensed settlement agents. They administer settlement but don’t give legal advice or negotiate terms. A qualified property lawyer does both — for the same fixed fee.
Transfer Duty via RevenueWA
