How NSW transfer duty is calculated
Transfer duty is worked out on the higher of the purchase price and the market value of the property, on a sliding scale. These are the 2026-27 general rates:
| Dutiable value | Duty payable |
|---|---|
| $0 - $18,000 | $1.25 for every $100 (minimum $20) |
| $18,001 - $38,000 | $225 plus $1.50 for every $100 over $18,000 |
| $38,001 - $103,000 | $525 plus $1.75 for every $100 over $38,000 |
| $103,001 - $387,000 | $1,662 plus $3.50 for every $100 over $103,000 |
| $387,001 - $1,290,000 | $11,602 plus $4.50 for every $100 over $387,000 |
| $1,290,001 - $3,870,000 | $52,237 plus $5.50 for every $100 over $1,290,000 |
| Over $3,870,000 (residential) | $194,137 plus $7.00 for every $100 over $3,870,000 |
Commercial property above $1,290,000 stays at the $5.50 rate. The $7.00 premium rate applies to residential property only.
Stamp duty FAQs
Who pays stamp duty in NSW?
The buyer pays transfer duty (commonly called stamp duty) on the purchase of NSW property. Sellers do not pay transfer duty on a sale.
When is stamp duty due?
Duty is generally payable within 3 months after contracts are exchanged, and in practice it is usually paid through the settlement. For off the plan purchases of a home, payment can generally be deferred until settlement or 12 months after the contract date, whichever comes first, subject to eligibility.
How does the first home buyer exemption work?
For a home, eligible first home buyers pay no transfer duty up to $800,000 and a reduced amount between $800,000 and $1,000,000. For vacant residential land, there is no duty up to $350,000 and a reduced amount between $350,000 and $450,000. Above those amounts, full duty applies. Eligibility conditions include living in the home within 12 months and for at least 6 continuous months.
What is the foreign purchaser surcharge?
A foreign person buying residential property in NSW pays surcharge purchaser duty of 9% on top of general transfer duty. Where only some buyers are foreign persons, the surcharge generally applies to their share. This calculator applies it to the full price as a cautious estimate.
Is stamp duty payable on vacant land and commercial property?
Yes. Vacant land and commercial property are dutiable at the general rates. The premium rate above $3,870,000 applies to residential property only, and first home buyer concessions apply only to residential property bought by eligible individuals.
Does this include all my purchase costs?
No. This estimate covers transfer duty, any foreign purchaser surcharge and the Land Registry registration fees. Your conveyancing fee, searches, PEXA fees and any lender costs are extra. Our quote tool gives you the full picture in one email.
