Probate is the legal process of administering a person's estate after they die, in accordance with the provisions set out in their Will. It involves an application to the Supreme Court for a grant of probate. Once the grant is made, we will arrange to secure all of the assets of the estate, payout all estate liabilities, and distribute the proceeds of the estate to the beneficiaries stipulated in the Will.
If someone passes away without a Will, we can undertake a similar process and apply for Letters of Administration, which is when the laws of intestacy apply. The laws of intestacy will stipulate who is to receive the net assets of the estate, and in which order.
